Terms of Service

1. Who we are and acceptance of these terms
Loyalem (“we”, “us”, “our”) operates loyalem.com and the Loyalem platform (together, the “Service”). By accessing or using the Service, you agree to be bound by these Terms of Service. If you use the Service on behalf of a business, you represent that you are authorized to bind that business.
2. The Service
Loyalem provides tools for businesses and individuals, including digital loyalty cards and passes for mobile wallets, digital business cards, websites, AI-assisted design and marketing content, and related messaging and analytics features. Features may evolve over time.
3. Accounts and eligibility
You must be at least 18 years old and provide accurate information when creating an account. You are responsible for safeguarding your credentials and for all activity under your account. Access to the platform may be provided by invitation or under an individual agreement.
4. Acceptable use
When using the Service, you agree not to:
- violate applicable laws or the rights of others;
- send unlawful, deceptive or unsolicited messages through the Service;
- upload content that is illegal, infringing or harmful;
- interfere with or attempt to disrupt the operation or security of the Service;
- violate the applicable policies of third-party platforms used with the Service (such as Apple Wallet or Google Wallet).
We may suspend or terminate access for violations of this section.
5. Your content and your customers' data
You retain all rights to the content you provide (such as logos, images, text and business information). You grant us the rights needed to host and process that content in order to provide the Service. Where you use the Service to process personal data of your own customers (for example in a loyalty program), you act as the data controller and Loyalem processes such data on your behalf. Details are described in our Privacy Policy and, where applicable, a data processing agreement.
6. AI-generated content
The Service can generate websites, designs, images and text with the help of artificial intelligence. AI output may contain errors. You are responsible for reviewing generated content before using or publishing it, and for ensuring that materials you provide as input do not infringe third-party rights.
7. Third-party services
Apple Wallet and Google Wallet are products and trademarks of Apple Inc. and Google LLC respectively. Loyalem is not affiliated with, endorsed by or sponsored by Apple or Google. Your use of third-party platforms is governed by their own terms.
8. Fees
Fees, if any, are set out in your individual agreement or order with us. Unless stated otherwise, fees are exclusive of applicable taxes.
9. Intellectual property
The Service, including its software, design and content provided by us, is owned by us or our licensors and is protected by intellectual property laws. These terms do not grant you any rights other than those expressly stated.
10. Availability and disclaimer
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee uninterrupted or error-free operation.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of profits, revenue or data. Our total liability arising out of or relating to the Service is limited to the amounts you paid us in the twelve (12) months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited under applicable law.
12. Termination
You may stop using the Service at any time; paid subscriptions end according to your agreement. We may suspend or terminate the Service for material breach of these terms. Sections that by their nature should survive termination (including sections 5, 9–11 and 14) survive.
13. Changes to these terms
We may update these terms from time to time. We will announce material changes on this page or by other reasonable means. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
14. Governing law
These terms are governed by the laws of India. If you are a consumer in the European Union, the mandatory consumer-protection provisions of the law of your country of residence remain unaffected.
